Terms of service

You must be able to form a binding contract in your jurisdiction. You are responsible for maintaining the confidentiality of credentials and for activity under your account. Notify us promptly of unauthorized use.

We provide a software platform that may include AI-assisted workflows, campaign tooling, integrations with third-party advertising platforms, analytics, and related features. Features may change as we improve the product. We may suspend or limit access for maintenance, security, or abuse prevention.

You agree to:

• Provide accurate information and keep it up to date.
• Use the Services only in compliance with applicable law, platform policies, and these Terms.
• Obtain all rights, consents, and authorizations needed for data you submit or connect (including ad account access and creative assets).
• Not attempt to probe, scan, or test the vulnerability of our systems without authorization.
• Not misuse the Services to distribute malware, spam, or infringing content.

The Services may interoperate with Meta, Google, and other partners. Your use of those platforms remains subject to their terms and policies. We are not responsible for partner outages, policy changes, or account enforcement actions taken by partners.

AI-generated suggestions may be incorrect, incomplete, or unsuitable for your brand or regulatory context. You are responsible for reviewing outputs before publication or spend decisions. See our AI usage disclosure for additional detail.

Paid plans, credits, and add-ons are described at purchase. Fees are non-refundable except as stated in our Refund policy or where required by law. You are responsible for applicable taxes unless we state otherwise.

We retain all rights in the Services, software, and branding. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Services for your internal business purposes. You retain rights in your own content; you grant us a license to host, process, and display your content as needed to operate the Services.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), IF YOU HAVE NOT PAID FEES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

You will defend and indemnify us against claims arising from your use of the Services, your content, your violation of these Terms, or your violation of applicable law or third-party rights.

You may stop using the Services at any time. We may suspend or terminate access for breach, risk, or legal reasons. Provisions that by their nature should survive (including disclaimers, limitations, indemnity, and dispute terms) will survive termination.

These Terms are governed by the laws of the jurisdiction where MagikBull operating entity’s principal place of business is established, without regard to conflict-of-law rules, unless mandatory consumer protections in your country say otherwise. Courts in that jurisdiction have exclusive jurisdiction, subject to non-waivable rights you may have to bring claims in your home courts.

We may modify these Terms. If a change is material, we will provide notice as appropriate (for example, by email or in-product notice). Continued use after the effective date may constitute acceptance.
